The Mumbai Police Cyber ​​Cell has filed a case against Kundra under the relevant sections of the Indian Penal Code, the Obscene Image of Women (Prevention) Act and the Information Technology Act for allegedly distributing / transmitting sexually explicit videos.

Fearing arrest, Kundra, who is married to actor Shilpa Shetty, first went to court for bail, but was refused, so he moved HK, claiming that he had been framed. The FIR has named actors Sherlyn Chopra and Poonam Pandey as co-accused.

According to his lawyers, he was in no way associated with the creation of content, publication or transmission of the alleged illegal videos, even though the actors, who were named as co-defendants, gave full consent to the filming of the videos.

In July of this year, Kundra was arrested by the Mumbai police in a different case when he was accused of distributing porn films via an app. He was released on bail in September.
